These Terms of Use ("Terms") govern your access to and use of the website located at iconicbuildanddesign.com and any related pages, forms, galleries, and online tools operated by Iconic Build and Design (the "Site"). Please read them carefully. If you do not agree to these Terms, do not use the Site.

1. ACCEPTANCE OF TERMS

By accessing, browsing, or otherwise using the Site, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated here by reference. If you use the Site on behalf of a company, homeowners association, or other entity, you represent that you have authority to bind that entity to these Terms, and "you" refers to that entity.

These Terms apply only to your use of the Site. They do not replace, modify, or limit the terms of any signed construction contract, proposal, change order, or written agreement between you and Iconic Build and Design. Where a signed agreement and these Terms conflict, the signed agreement controls as to the work described in it.

2. ABOUT ICONIC BUILD AND DESIGN

Iconic Build and Design is the assumed name of Bles Capital, LLC. We are a residential and commercial general contractor serving the Charlotte metropolitan area and surrounding communities in North Carolina and South Carolina.

References on the Site to "Iconic," "we," "us," and "our" mean Iconic Build and Design. Service availability is subject to change.

3. ELIGIBILITY

The Site is intended for users who are at least eighteen (18) years of age and who are legally capable of entering into binding contracts. By using the Site or submitting any inquiry, you represent that you meet these requirements. The Site is not directed to children, and we do not knowingly collect information from anyone under thirteen (13) years of age.

4. PERMITTED USE OF THE SITE

We grant you a limited, revocable, non-exclusive, non-transferable license to access and view the Site for your own personal, non-commercial purposes related to evaluating, requesting, or managing construction services from Iconic Build and Design. All other uses require our prior written permission.

5. PROHIBITED CONDUCT

You agree not to:

  - Copy, reproduce, republish, scrape, mirror, or redistribute any portion of the Site, including project photography, written descriptions, pricing frameworks, or downloadable materials, without our prior written consent.
  - Use the Site or any content from it to build, train, or improve any competing service, database, lead list, or machine learning model.
  - Submit false, misleading, or fraudulent information through any form, including project inquiries or estimate requests.
  - Attempt to gain unauthorized access to the Site, its servers, or any connected system; introduce malware; or interfere with the Site's normal operation.
  - Use automated systems, bots, or harvesters to extract contact information or content from the Site.
  - Use the Site in any manner that violates applicable federal, state, or local law, or any building, licensing, or advertising regulation.

We may suspend or terminate your access to the Site at any time, without notice, for conduct we reasonably believe violates these Terms.

6. NO CONTRACT FORMATION THROUGH THE SITE

Nothing on the Site constitutes an offer to perform work, a binding bid, a guarantee of availability, or a commitment to any price, scope, or schedule. Project galleries, service descriptions, pricing ranges, timeline tiers, and similar content are provided for general informational purposes only.

Submitting a contact form, estimate request, or consultation request does not create a contractual relationship, does not reserve a place in our schedule, and does not obligate either party to proceed. Iconic Build and Design is bound only by a written proposal or contract that has been signed by an authorized representative of Iconic Build and Design and executed by the client.

7. ESTIMATES, PRICING, AND PROJECT INFORMATION

Any pricing, cost range, timeline, or duration referenced on the Site is illustrative only and is based on general market conditions and typical project assumptions. Actual project cost and schedule depend on factors including but not limited to site conditions, existing structural and mechanical conditions, material selections and availability, permitting and inspection timelines, jurisdictional requirements, homeowners association or architectural review approvals, subcontractor availability, weather, and the final agreed scope of work.

Published timelines describe expected construction duration only and exclude design, selections, permitting review, and lead times unless expressly stated. All figures are subject to verification and formal written proposal. We reserve the right to correct any pricing, availability, or descriptive error on the Site at any time without notice.

8. SITE CONTENT IS NOT PROFESSIONAL ADVICE

Content on the Site, including articles, guides, checklists, glossaries, process descriptions, and downloadable resources, is general information about construction and remodeling. It is not architectural, structural engineering, code compliance, legal, insurance, tax, real estate, or financial advice, and it is not a substitute for a licensed professional's evaluation of your specific property.

Do not rely on Site content to perform construction work yourself or to determine whether a condition at your property is safe, code-compliant, or permitted. Building codes and permitting requirements vary by jurisdiction and change over time. Always consult a qualified licensed professional and your local building department before acting.

9. INTELLECTUAL PROPERTY

The Site and all content on it, including text, layout, graphics, photographs, video, illustrations, process documentation, document templates, and the selection and arrangement of that content, are owned by Iconic Build and Design or its licensors and are protected by United States copyright, trademark, and other intellectual property laws.

The Iconic Build and Design name, the Iconic building mark and logo, "Build Bold. Design Iconic.", and the Iconic Project Book™ are trademarks or service marks of Iconic Build and Design. You may not use them without our prior written permission. All rights not expressly granted in these Terms are reserved.

10. PROJECT PHOTOGRAPHY AND PORTFOLIO CONTENT

Photographs, renderings, and project descriptions displayed on the Site depict completed or in-progress work and are provided as examples of our craftsmanship. They do not represent a guarantee that any future project will achieve the same appearance, finish, material, cost, or schedule. Some images may be professionally styled, staged, digitally enhanced, or produced for design visualization, and finishes shown may no longer be available.

Where images include third-party design work, products, or furnishings, those items are the property of their respective owners and are shown for illustration only.

11. YOUR SUBMISSIONS

If you submit information through the Site, including project descriptions, measurements, photographs, drawings, inspection reports, budget information, or reviews, you represent that you have the right to share that material and that it does not infringe anyone else's rights.

You grant Iconic Build and Design a non-exclusive, royalty-free license to use, store, reproduce, and internally distribute your submission for the purpose of evaluating your inquiry, preparing an estimate or proposal, and performing services. We will not publish your submitted photographs or identifying project details in marketing materials without separate permission from you.

Unless you and Iconic Build and Design have signed a written confidentiality agreement, submissions through the Site are not treated as confidential. Do not submit sensitive personal information such as Social Security numbers, financial account numbers, or payment card data through Site forms.

12. COMMUNICATIONS AND TEXT MESSAGING

By providing your telephone number or email address through the Site, you consent to receive communications from Iconic Build and Design relating to your inquiry and any resulting project, including phone calls, emails, and SMS or text messages, which may be sent using an automated system.

  - Consent to receive marketing text messages is not a condition of purchasing any goods or services.
  - Message and data rates may apply. Message frequency varies.
  - Reply STOP to opt out of text messages, or HELP for assistance. Opting out of marketing messages does not stop transactional messages about an active project, such as scheduling and inspection notices.
  - You may unsubscribe from marketing emails using the link in any such email.

You are responsible for notifying us if your phone number changes or is reassigned.

13. PRIVACY

Our collection and use of personal information submitted through the Site is described in our Privacy Policy. By using the Site, you consent to the practices described there. Please review it before submitting any information.

14. THIRD-PARTY LINKS, TOOLS, AND SERVICES

The Site may link to or integrate third-party websites, platforms, and tools, including project management and estimating platforms, scheduling tools, review platforms, mapping services, financing partners, and payment processors. These are provided for convenience only.

Iconic Build and Design does not control and is not responsible for the content, availability, security, pricing, terms, or privacy practices of any third party. Your use of a third-party service is governed by that provider's own terms and privacy policy, and any transaction you conduct with a third party is solely between you and that party.

15. DISCLAIMER OF WARRANTIES

THE SITE AND ALL CONTENT ON IT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, ICONIC BUILD AND DESIGN DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SITE OR ITS SERVERS ARE FREE OF HARMFUL COMPONENTS. WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, OR CURRENCY OF ANY CONTENT ON THE SITE.

This section applies to the Site only. It does not disclaim, limit, or waive any workmanship warranty, express warranty, or statutory warranty provided under a signed construction contract with Iconic Build and Design.

16. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, ICONIC BUILD AND DESIGN AND ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, AND SUBCONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SITE, WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY, OR ANY OTHER THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY ARISING FROM OR RELATING TO YOUR USE OF THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100.00).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so portions of the above may not apply to you. Nothing in these Terms limits liability that cannot lawfully be limited. This section governs Site use only and does not limit liability arising under a signed construction contract.

17. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Iconic Build and Design and its owners, officers, employees, and agents from and against any claims, damages, liabilities, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or related to your use of the Site, your violation of these Terms, your violation of any law, or your infringement of any third party's rights.

18. GOVERNING LAW AND DISPUTE RESOLUTION

These Terms are governed by the laws of the State of North Carolina, without regard to its conflict of laws principles. You agree that any dispute arising out of or relating to these Terms or your use of the Site will be brought exclusively in the state or federal courts located in Mecklenburg County, North Carolina, and you consent to the personal jurisdiction and venue of those courts.

This section applies to disputes about the Site. Disputes arising under a signed construction contract are governed by the dispute resolution provisions of that contract.

19. CHANGES TO THESE TERMS

We may revise these Terms at any time by posting an updated version on the Site and changing the "Last Updated" date above. Changes take effect when posted. Your continued use of the Site after that date constitutes acceptance of the revised Terms. We recommend reviewing this page periodically.

20. GENERAL PROVISIONS

If any provision of these Terms is found unenforceable, that provision will be limited or severed to the minimum extent necessary, and the remaining provisions will remain in full force. Our failure to enforce any provision is not a waiver of it. You may not assign these Terms without our written consent; we may assign them freely. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Iconic Build and Design regarding your use of the Site. Section headings are for convenience only and do not affect interpretation.
